Terms Of Service

These Terms & Conditions (“Agreement”) apply to all travel bookings made through KBR Travel Retreats (“I,” “me,” “my,” or “KBR Travel Retreats”), a travel advisor operating independently in Bryan County, Oklahoma. By engaging my services or submitting a payment for a trip, you (“you” or “the client”) acknowledge and agree to be legally bound by the following terms in their entirety.

1. CONSENT TO TERMS

By requesting travel arrangements, submitting payment, authorizing me to submit a payment on your behalf, or otherwise engaging my services, you acknowledge that you have read, understood, and accepted these Terms & Conditions. No person may alter or waive any provision herein unless expressly authorized in writing by me.

2. TRAVEL DOCUMENTATION & IDENTIFICATION

It is solely your responsibility to ensure that you have the required documentation (including valid passports, visas, proof of vaccinations, and any other necessary documents) for all travel. Passports must typically be valid for at least six months beyond your return date. Failure to present appropriate documents may result in denial of boarding, entry, or other delays for which I am not liable. For current TSA and U.S. entry/exit regulations, refer to tsa.gov, travel.state.gov, or your local consulate.

3. HEALTH, SAFETY & TRAVEL RISK

Travel may expose you to health, security, or environmental risks. I make no guarantees regarding the safety or conditions of any destination. You acknowledge that travel to some locations may be dangerous, and you accept full responsibility for your decision to travel. You are encouraged to review government travel advisories at travel.state.gov and to register with the U.S. Smart Traveler Enrollment Program (STEP). It is your responsibility to verify required vaccinations and medical precautions. I am not liable for any injuries, losses, or conditions arising from environmental factors such as:

• Dangerous ocean or pool conditions, tides, or currents

• Lack of lifeguards or supervised areas

• Excessive seaweed (sargassum), poor air or water quality

• Wildlife exposure or insect activity

• Accidental injuries caused by alcohol, drugs, or other impairing substances

• Medical events requiring treatment or transport

4. CONDITIONS OF PARTICIPATION

You affirm that you are at least 18 years old and legally able to enter into this agreement. You agree not to make false or speculative reservations and that all information provided is accurate. I reserve the right to cancel your booking if these terms are violated.

5. LIMITATION OF LIABILITY

I act solely as an agent between you and travel suppliers (airlines, hotels, cruise lines, transfer companies, tour operators, etc.). I do not own, control, or operate any travel service provider and am not responsible for their acts or omissions. This includes, but is not limited to: delays, cancellations, injury, damage, illness, loss, accident, or force majeure events. You release me from any liability arising from supplier failures, strikes, bankruptcies, acts of war or terrorism, weather disruptions, or any other uncontrollable circumstances.

6. FORCE MAJEURE

I shall not be liable for any failure to perform my obligations or provide services due to causes beyond my control, including but not limited to: natural disasters, pandemics, weather events, government actions, labor disputes, border closures, or travel bans. Refunds, credits, or rebooking options in such cases are subject to the policies of the travel supplier(s) involved.

7. CANCELLATIONS & FEES

All bookings are subject to the cancellation policies of the specific travel supplier. In addition to supplier penalties, I may impose a non-refundable cancellation fee of $50 per traveler for services rendered prior to cancellation. This cancellation fee is due immediately and may not be covered by travel insurance. I cannot waive third-party supplier penalties under any circumstance.

8. PAYMENTS

Final payment deadlines and payment schedules are governed by the travel supplier(s). Failure to make payment on time may result in cancellation of your reservation and loss of any deposits. I do not retain client funds and do not process payments directly — all payments are processed securely through the travel supplier or authorized booking platform.

9. TRAVEL PROTECTION

You are strongly encouraged to purchase travel insurance to protect against trip interruption, medical emergencies, supplier default, weather delays, and other covered events. Travel insurance is optional but highly recommended. I am not licensed to interpret coverage. All claims must be submitted directly to the insurance provider. Declining coverage is entirely at your own risk, and you acknowledge that refunds may not be available if issues arise.

9A. FLIGHT CHECK-IN, SEAT ASSIGNMENTS & AIRLINE COMMUNICATIONS

To protect your privacy and comply with airline policies, clients are responsible for checking themselves in for flights and agreeing to any airline terms or conditions. I may send a reminder or assist with general questions, but I do not complete online check-in or accept airline terms on your behalf. You are responsible for confirming your flight details, selecting seats, purchasing bags, and monitoring updates such as delays, cancellations, or gate changes. I am not liable for any missed flights, denied boarding, or schedule disruptions resulting from incomplete check-ins or airline communication issues.

10. TRAVELER CONDUCT & RESPONSIBILITY

You are responsible for your behavior during travel and any consequences resulting from intoxication, criminal activity, property damage, or failure to comply with laws of the destination country. This includes consequences of:

• Excessive alcohol or drug use

• Possession or use of illegal or controlled substances (even if legal in the U.S.)

• Disorderly conduct or disrespect of local customs or laws

• Refusal to follow resort, airline, or government rules

11. ALLERGIES & FOOD SENSITIVITIES

I cannot guarantee allergen-free accommodations or meals. You must notify suppliers directly of any dietary needs and are solely responsible for managing allergies or medical conditions. I am not liable for any reactions or medical emergencies related to food or environmental exposure.

12. MODIFICATIONS & CHANGES

Changes to existing bookings are subject to availability and supplier approval. Any modification may incur administrative fees or price differences. I reserve the right to charge a change fee of $25 per traveler for adjustments requested after deposit.

13. PHOTOGRAPHY & MEDIA RELEASE

Unless otherwise requested in writing, you grant KBR Travel Retreats permission to use non-identifying photos or testimonials submitted voluntarily (e.g., via social media, reviews, or email) for marketing purposes.

14. DISPUTE RESOLUTION & ARBITRATION

In the event of a dispute between you and KBR Travel Retreats, both parties agree to resolve the matter through binding arbitration in Bryan County, Oklahoma, under the rules of the American Arbitration Association. You waive your right to file a lawsuit or participate in a class action. Each party is responsible for their own legal costs.

15. GOVERNING LAW

This Agreement shall be governed exclusively by the laws of the State of Oklahoma. Jurisdiction and venue for any legal action, including arbitration, shall lie solely in Bryan County, Oklahoma.

16. PRIVACY POLICY

Your personal information is used solely to facilitate your travel arrangements and is not sold or shared beyond what is required to complete your booking. Refer to my full Privacy Policy [www.kbrtravelretreats.com/privacy-policy] for more information.

17. PAYMENT AUTHORIZATION

By providing your payment information and verbally, electronically, or in writing authorizing me to apply payment on your behalf, you agree that KBR Travel Retreats is permitted to charge the agreed-upon amount for your travel arrangements. You acknowledge that this constitutes valid authorization, even if the charge is submitted by me on your behalf using your payment details. You further agree that this authorization binds you to the Terms & Conditions outlined in this document.

18. ACCEPTANCE OF TERMS

By making a booking or submitting payment through KBR Travel Retreats — whether directly or through authorized payment by me on your behalf — you acknowledge that you have read, understood, and agree to all terms above. These Terms & Conditions represent the entire agreement and supersede all prior verbal or written communications.
